Family-Sponsored Visa Petition Services

Under the Immigration and Nationality Act (INA), citizens and lawful permanent residents can submit visa petitions for various qualifying family-members. The INA makes a distinction between “immediate relatives” and other family relationships.

“Immediate Relative” visa petitions

Under the §201(b)(2) of the INA, “immediate relatives” are defined as follows:

  • Spouses of US Citizens;
  • Unmarried children under age 21 of US Citizens; and
  • Parents of US Citizens (if the citizen is older than 21).

The difference between “immediate relative” visa petitions and those submitted under the other family-sponsored visa categories is that visas are available immediately for qualifying “immediate relatives.” Residence status acquired through marriage is usually conditional for 2 years.

Other family-sponsored visa petitions

Unlike the immediate-relative category, the issuance of visas in the other family-sponsored categories are subject to an annual numerical limitation. The other family-sponsored preference categories under INA §§202-204 are:

  • Unmarried Sons and Daughters of U.S. Citizens (F1)
  • Spouses (F2A) and Unmarried Sons and Daughters of Permanent Resident Noncitizens (F2B)
  • Married Sons and Daughters of US Citizens (F3)
  • Brothers and Sisters of U.S. Adult Citizens (F4)
